Article 3bis
Payment service providers
Payments on the KolyMe Platform are processed by the following providers, each according to the payment method chosen by the user:
- Stripe (bank cards): Stripe Payments Europe Ltd, acting via Stripe Connect on behalf of Resolvue, LLC. Funds related to card payments flow through Stripe Connect accounts and are never held in Resolvue's own accounts.
- FedaPay (mobile wallets): FedaPay, based in Cotonou (Benin), for West African mobile-wallet payments.
- MTN Mobile Money: direct integration with the MTN Open API for MTN MoMo mobile-wallet payments.
Resolvue, LLC maintains an operating bank account opened through Mercury Technologies, Inc., a banking platform whose deposits are held by FDIC-insured partner banks (Choice Financial Group and Column N.A.).

Intellectual property
4.1 Resolvue's rights
All elements making up the KolyMe Platform (text, graphics, logos, videos, icons, sounds, software, databases) are the exclusive property of Resolvue or its partners and are protected by intellectual property laws in force.
Any reproduction, representation, modification, publication or adaptation, in whole or in part, of the Platform, by any means or process, is prohibited without the prior written authorisation of Resolvue, except for legal exceptions (notably private use).
4.2 Trademarks
The KolyMe and Resolvue trademarks, domain names and logos are the property of Resolvue. Any unauthorised reproduction, imitation or use is liable to prosecution.
4.3 Databases
Resolvue is the producer of the databases accessible through the Platform. Any substantial extraction or re-use, whether qualitative or quantitative, is prohibited without prior authorisation, in accordance with the legal provisions applicable to database protection.

The processing of personal data is governed by a separate Privacy Policy, accessible from the Platform footer. For any question, you may contact our Data Protection Officer (see Article 6).

Representative in the European Union (Article 27 GDPR)
In accordance with Article 27 of Regulation (EU) 2016/679 (GDPR), Resolvue, as a controller established outside the European Union offering its services to persons located in the Union, designates a representative in the Union to serve as the point of contact for supervisory authorities and data subjects.
The representative designation is currently in progress. Contact details will be published before the service is officially opened to users residing in the European Union.

The use of cookies and similar technologies on the KolyMe Platform is governed by a separate Cookie Policy, accessible from the Platform footer.

Hyperlinks
9.1 Outgoing links
The KolyMe Platform may contain links to third-party sites. Resolvue exercises no control over these sites and declines any responsibility for their content, practices or privacy policies.
9.2 Incoming links
Creating a hyperlink to the KolyMe Platform is allowed provided it does not harm the image of Resolvue and that it clearly indicates the origin of the content. Resolvue reserves the right to request the removal of any link deemed inappropriate.

Service availability
Resolvue uses reasonable means to ensure that the KolyMe Platform is available 24 hours a day, 7 days a week. Interruptions may nonetheless occur for maintenance, updates or in the event of a technical incident. Resolvue cannot be held liable for these interruptions or for their possible consequences.

Editorial liability limitation
Resolvue takes particular care over the quality and accuracy of the information published on the KolyMe Platform. It cannot, however, guarantee the absence of errors or omissions. Any inaccuracy may be reported to: contact@kolyme.com.

Digital accessibility
Resolvue strives to make the KolyMe Platform accessible to as many users as possible, including persons with disabilities, by following the W3C recommendations (WCAG 2.1). Users encountering access difficulties may contact us at: contact@kolyme.com.
Article 13
Applicable law and competent jurisdiction
These legal notices are governed by Beninese law. Any dispute relating to their interpretation or performance falls under the jurisdiction of the courts of Cotonou, subject to:
- mandatory consumer protection rules in force in the user's country of residence, where these are of public order;
- the mandatory jurisdictional rules provided by Regulation (EU) No. 1215/2012 (Brussels I bis) for users residing in the European Union.
